Terms of Service

Effective September 10, 2026. These terms govern index.statusbird.io, the free store check, the Exposure Report, the Portfolio Sweep and any dataset licence, all provided by StatusBird LLC, an Arizona limited liability company ("StatusBird", "we"). By using the site or placing an order you agree to them. They are separate from the terms of the StatusBird monitoring application.

1. What the service is, and is not

The October 1 Index and its reports are independent research. They record what a publicly accessible storefront loaded when we fetched it, on the date shown, using the method published on the methodology page. They attribute scripts to the app vendors whose hosts serve them and classify how each script is loaded.

The service is not legal, compliance, security or accessibility advice, and nothing in a report is a statement that a storefront, an app or a business complies or fails to comply with any law, regulation, standard or platform policy. Automated checks find a subset of issues; the absence of a finding is not a statement that none exists. You are responsible for decisions you make on the basis of a report, and we recommend obtaining professional advice for legal or compliance questions.

StatusBird LLC is not affiliated with, endorsed by or sponsored by Shopify Inc. or any app vendor named on the index. Shopify is a trademark of Shopify Inc. App and vendor names are used only to identify the products concerned.

2. The free store check

The check fetches one public homepage per request and is limited to five checks per visitor per hour. You may use it only for storefronts you own, manage, or are evaluating for a legitimate purpose. You may not use it, or the index, to harass any business, to send unsolicited commercial email in breach of applicable law, or to assemble a list for litigation targeting. Automated or scripted use of the check is not permitted; the dataset licence exists for that purpose.

3. Orders, delivery and price

• Exposure Report: one storefront, five page types, delivered by email as a PDF and a JSON evidence file within 48 hours of payment, followed by weekly re-checks of the same pages for 30 days with an email only when a new legacy script tag or a new tracker appears. Price as shown at checkout, currently $399 plus applicable tax.
• Portfolio Sweep: every client store on one agency's list, delivered within 48 hours of receiving the list, as one document with a page per store. Price as shown at checkout, currently $999 plus applicable tax, for orders placed on or before October 1, 2026.
• Dataset licence: aggregate index data licensed on written terms agreed case by case. The dataset is never licensed to law firms acting for plaintiffs in claims against the businesses it describes.

Prices are in US dollars. Payment is taken by Stripe at the time of order. Tax is calculated at checkout according to your billing address.

4. Refunds

If an Exposure Report finds nothing on any of the five page types (no legacy script tag, no tracker before interaction, no critical or serious accessibility failure, no missing Merchant Center field), we refund the order in full. If we cannot fetch the storefront you named after reasonable attempts, we refund in full. Otherwise, because a report is produced to order and delivered in full on delivery, it is not refundable once delivered. A Portfolio Sweep is refundable in full until we have started generating it, and pro rata by stores completed afterwards. Refund requests go to index@statusbird.io and are processed to the original payment method within ten business days.

5. Your rights in what we deliver

On payment you receive a perpetual, non-exclusive licence to use, copy and forward the report and evidence delivered to you for your own business purposes and those of the clients whose stores it covers, including sharing it with vendors, advisers, insurers and counsel. You may not resell a report as a standalone product, remove the issuer, date or evidence seal, or present an altered copy as ours. We retain ownership of the method, the templates and the index.

6. Accuracy, corrections and vendor replies

We take care to fetch and classify correctly and we publish our method. Storefronts change, and a report describes one fetch on one date. If you believe a finding is wrong, email index@statusbird.io with the store and the finding; we re-fetch, and if we were wrong we correct the record, tell anyone we sent it to, and refund the affected order if you ask. App vendors named on the index have the free responses set out on the vendor page: corrections published verbatim, migration notices linked, and verified checks, each answered within one business day.

7. Your responsibilities

You confirm that the domains you submit are ones you own, manage, or are evaluating for a legitimate purpose; that you will not use the service to harm, harass or defame any business; and that you will comply with applicable law in any use you make of a report, including laws on unsolicited email if you forward it.

8. Disclaimer of warranties

THE SITE, THE INDEX AND EVERY REPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, STATUSBIRD LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT A REPORT IS COMPLETE OR THAT A STOREFRONT DESCRIBED AS CLEAR HAS NO ISSUES. WE DO NOT WARRANT THAT ANY VENDOR WILL OR WILL NOT MIGRATE, OR THAT SHOPIFY WILL KEEP TO THE DATES IT HAS PUBLISHED.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STATUSBIRD LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM THE SERVICE, HOWEVER CAUSED. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER, AND FOR ANY OTHER CLAIM TO ONE HUNDRED US DOLLARS. Some jurisdictions do not allow certain limitations; in those, our liability is limited to the smallest amount the law allows.

10. Indemnity

You will indemnify StatusBird LLC against third-party claims arising from your breach of section 2 or section 7, or from your use of a report in breach of applicable law.

11. Suspension and termination

We may refuse or cancel an order, or block use of the free check, where we reasonably believe these terms are being breached, refunding any payment for undelivered work. You may stop using the service at any time.

12. Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Before bringing a claim, each party agrees to try in good faith to resolve it by email for 30 days. Any claim not so resolved will be brought in the state or federal courts located in Maricopa County, Arizona, and each party consents to their jurisdiction, except that either party may seek injunctive relief in any competent court. Nothing here limits any consumer rights you have under the law of your place of residence that cannot be excluded by agreement.

13. Changes

We may update these terms by posting a new version on this page with a new effective date. Orders are governed by the terms in force when they are placed.
